Mallowly Terms of Use
Version 0.4 / 2026-10-19Welcome to Mallowly (the "App"). The App is provided by an operator registered in Taiwan ("we" or "us"). It's a companion-style AI roommate: a roommate moves in and lives with you (whatever it looks like, we call it "your mochi" below), and you can play with it, chat, have heart-to-heart talks, and show it photos. By using the App, you agree to these terms and the Privacy Policy. If you don't agree, please stop using the App.
1. What this service is
The App gives you an interactive virtual roommate (your mochi). Features include patting it, doing things together, mini games, text chat (Just chat / Heart to heart), and showing it photos to build a memory journal. The App is not a medical, counseling, or any other professional service. Everything your mochi says is fictional, companion-style interaction.
The App is in beta. Features may change, pause, or break at any time. We'll do our best to keep your data safe, but please don't treat the App as the only place you keep anything important.
2. AI replies and their limits
Chat replies are generated by a cloud AI service: the content needed to write a reply (what you say, recent messages, what your mochi remembers, and photos you show your mochi) is sent through our server to an AI service provider. See the Privacy Policy for details. You agree to this when you sign in; the App has no "on-device AI only" option. If the cloud has a temporary problem, the AI model built into your phone may step in for a reply; if the age rules don't allow cloud AI, replies always come from the on-device model. If you don't want your chats sent to an AI service, you can stop using the App and delete your account and the data on our server with "Delete account and data" under Settings › Privacy & data.
AI-generated content can be wrong, inaccurate, or inappropriate. It does not represent the views of the App's developer and is not professional advice (medical, mental health, legal, or any other field). Please use your own judgment about whether an AI reply can be trusted, and don't make important decisions based only on what your mochi says.
If the way the AI works changes, these terms and the Privacy Policy will be updated, and you'll be told in the App.
3. Heart to heart and safety
When you use Heart to heart or other text chat features, the App tries to judge, on your phone (on-device), whether a message may involve thoughts of self-harm.
If a message is judged high-risk, the App shows crisis helpline information (for example, the 988 Suicide & Crisis Lifeline in the US, findahelpline.com for other countries, and the 1925, 1995, and 1980 lines in Taiwan). This message is fixed text. It is never generated or rewritten by the chat AI.
When the App uses cloud AI, our server also checks each message for safety risks. A message judged a serious risk, and a message your phone judges high-risk while you're signed in, are kept separately for up to 90 days under the Privacy Policy, used only for safety and improving the service. For now only the developer looks at them, and we won't contact you privately about what we see.
This check can make mistakes (it may flag something by mistake, or miss something). Mallowly cannot replace professional help or emergency services. If you or someone you know is in danger or in an emergency right now, call your local emergency number directly (such as 911 in the US, or 110 / 119 in Taiwan). Don't rely on the App alone.
Your mochi is an AI, not a real person, and no one watches your chats live. You'll find this note at the top of Settings › Privacy & data too.
4. Where your data lives
- Your chat history, what your mochi remembers about you, and the photos and journal entries you make are stored on your own phone, and once you're signed in they're also backed up to our server so you can get them back on a new phone or after reinstalling (see the Privacy Policy). When the App uses cloud AI, the content needed to write a reply leaves your phone.
- You can clear your chat history and your mochi's memories anytime in Settings. Photos can be deleted one at a time in the album, or all at once under Settings › Privacy & data. Once you're signed in, the matching backup on our server is deleted too.
- Deleting the App deletes this data on your phone, and it can't be recovered; to delete the backup on our server, use "Delete account and data" under Settings › Privacy & data.
- For how we use this data (providing the service, keeping it safe, and improving Mallowly, plus the "Use my chats to help improve Mallowly" switch you can turn off), see the Privacy Policy.
5. Voice input
Hold-to-talk speech recognition happens on your phone (on-device). Recordings are never sent to a server. If your device doesn't support on-device speech recognition, this feature is turned off automatically, and you can still chat by typing.
6. Photos and camera access
The App only uses the one photo you take yourself, or actively pick from your library, to show your mochi. It never reads or scans your whole photo library. When you choose to save a journal or photo back to your library, the App only asks for "Add Photos Only" (write-only) access, not full library access.
7. Age and use by minors
The App is only for users 13 and older. If you are under 13, you may not use the App. If you are 13 to 17, you must have a parent or guardian's consent before using it; if you are 18 or older, you may use it on your own. We ask for your birthday when you start, to confirm your age; please enter it truthfully. A parent or guardian who consents also agrees to understand the App and guide the minor's use of it. Even if you meet the age requirement, anyone not yet mature enough to understand limits like "the AI can be wrong" and "Heart to heart is not professional help" should use the App with a parent or guardian's guidance and understanding.
8. Accounts and sign-in, no ads, no tracking
Users 13 and older need to sign in with an Apple or Google account to use the App. When you sign in, we receive that account's ID, email address, and related details, which we use to create your account, count your cloud allowance, and prevent abuse; the App also sends back usage data that contains no content under that account, and once you're signed in your roommate and related data are backed up to our server (see the Privacy Policy).
Please use only one account per person, and keep your Apple or Google account secure; you're responsible for what's done with your account. If you find someone else using your account, email us right away.
The App shows no ads and contains no third-party analytics or tracking SDKs. If a future version adds ads or third-party analytics, we'll update these terms and let you know. For who your data is sent to, and when, see the Privacy Policy.
9. Rules for using the App
When you use the App, please don't:
- Use it for anything illegal, or to violate someone else's rights, for example by uploading or sharing other people's photos or personal information without their consent.
- Upload sexual, violent, hateful, or harassing content, or anything involving the sexual exploitation of children.
- Lie about your age or birthday, pretend to be someone else, or let someone who doesn't meet the age rules in Section 7 use your account.
- Use software to send messages in bulk or extract data or your mochi's replies, or get around the chat allowance and usage limits, for example with multiple accounts.
- Hack, reverse engineer, or interfere with the App or our server, or try to get around its safety features (for example, using special wording to make the AI say things it shouldn't).
- Present your mochi's replies as written by a human, or use them to train or develop an AI model that competes with the App.
If you break these rules, we may suspend or end your account under Section 12.
10. Your content, your mochi's replies, and intellectual property
- The photos you show your mochi and the chat messages you type ("your content") remain yours. You allow us to store, transmit, and process your content under the Privacy Policy to provide the service, keep it safe, and, through "Improving Mallowly" in Section 3 of the Privacy Policy (which you can turn off), improve Mallowly.
- As between you and us, the replies your mochi generates with AI are yours, though an AI reply may be similar to what someone else receives.
- The App's name, the artwork for your mochi and other characters, its fixed lines, software, and other content are the intellectual property of us or those who license them to us.
- If you send us ideas or feedback, we may use them to improve Mallowly without paying you or crediting you by name.
11. Chat allowance, subscriptions, and payment
Mallowly is still in beta, and there's no paid plan yet. When the App uses cloud AI, each account can send 150 messages a week (counted again every Monday at 00:00, Taiwan time), with daily limits on photos and usage to prevent abuse. Once this week's messages are used up, regular chatting pauses until the count resets (your mochi answers with a fixed line); when you might need help, your messages are never limited. Want more chats, have an idea, or ran into a problem? Email us at mallowly.app@gmail.com.
The rest of this section applies once paid plans launch: the App may offer paid subscription plans in the future that let you chat with your mochi more often. Free and paying users get exactly the same AI model and safety features. Subscriptions are handled through the App Store, and Apple's standard rules apply:
- Subscriptions renew automatically unless you cancel before the end of the current period.
- You can view or cancel your subscription anytime in Apple ID settings → Subscriptions.
- All refunds follow Apple's refund policy and process. We don't handle payments or refunds directly.
- If prices or plans change, we'll tell you in the App beforehand; any period you've already paid for isn't affected.
12. Suspension, termination, and changes to the service
- You can stop using the App at any time and delete your account with "Delete account and data" under Settings › Privacy & data.
- If you break these terms or the law, abuse the service (for example, by getting around the chat allowance), or your use may harm other people or the service, we may suspend or end your account. When we can, we'll tell you first; if you think we got it wrong, email us to appeal.
- Features will change often during the beta. If we decide to shut down the whole service, we'll tell you in the App at least 30 days before, so you have time to download your data; anything you've paid for but not used is handled through Apple's refund process.
13. Assignment
You may not assign or transfer your rights or obligations under these Terms without our consent. We may assign or transfer these Terms and your account to a successor or affiliate in connection with a merger, acquisition, reorganization, sale of business or assets, or similar transaction. How your personal information is handled in that case is governed by the "If Mallowly is acquired or merged" section of our Privacy Policy, including advance notice and the chance to download or delete your data.
14. Disclaimer
The App is provided "as is." Especially during the beta, we don't guarantee that it will be uninterrupted, error-free, or completely accurate, or that your mochi's replies will suit your situation.
15. Limitation of liability and indemnity
- To the extent the law allows, we aren't liable for indirect, incidental, special, or consequential damages (such as lost profits, data, or goodwill), and our total liability to you is limited to the greater of what you paid us in the 12 months before the damage occurred or NT$3,000.
- The point above doesn't apply to damage caused by our intent or gross negligence, or to liability the law doesn't allow us to limit or exclude.
- If you break these terms or the law, or violate someone else's rights (for example, by uploading other people's photos without their consent), and someone makes a claim against us because of it, you're responsible under the law for the damage this causes us.
16. Changes to these terms
These terms may be updated from time to time. We'll update their version and date; for major changes we'll let you know in the App, and for major changes that work against you, we'll tell you at least 7 days before they take effect. If you don't agree, you can stop using the App and delete your account before then. If you keep using the App after a change takes effect, you agree to the updated terms; however, using your data for a materially different purpose is handled under the Privacy Policy, and this sentence does not apply to it. The App keeps a record of which version you agreed to.
17. Governing law, jurisdiction, and disputes
If something goes wrong, please email us first at mallowly.app@gmail.com, and we'll work with you to try to resolve it within 30 days. These terms are governed by the laws of the Republic of China (Taiwan). For any dispute arising from these terms or the App, both sides agree that the Taiwan Taipei District Court is the court of first instance, unless mandatory law provides otherwise (for example, the venue rules of Taiwan's Consumer Protection Act).
18. About Apple
These terms are an agreement between you and us, not between you and Apple Inc. ("Apple"). We, not Apple, are responsible for the App and its content, and Apple has no obligation to provide maintenance or support for it. If the App fails to meet a warranty that applies by law, you may notify Apple, and Apple will refund the purchase price of the App, if any; beyond that, to the extent the law allows, Apple has no other warranty obligation for the App. We, not Apple, handle any claims related to the App (such as product liability, failure to meet legal requirements, consumer protection, or a claim that the App infringes someone's intellectual property). When you use the App, you also need to follow the App Store's rules of use. Apple and its subsidiaries are beneficiaries of these terms and may enforce them against you.
19. Other terms
- These terms and the Privacy Policy are the whole agreement between you and us about the App.
- If any part of these terms is found invalid, the rest stays in effect.
- If we don't enforce a right right away, that doesn't mean we've given it up.
20. Contact us
If you have any questions about these terms, email us at mallowly.app@gmail.com.
